Artmuseo Archive Terms of Use Policy

1. Purpose of the Archive

Artmuseo | Archive exists as a public cultural and historical archive dedicated to the long-term preservation, contextualization, and public viewing of artistic works. The Archive is designed to function as a living record of human creativity—prioritizing continuity, provenance, and public trust over ephemerality.

By participating in the Archive, artists, organizations, and viewers acknowledge that Artmuseo is not a social media platform, marketplace alone, or temporary publishing tool, but a system intended to preserve artistic contributions as part of a shared cultural record.

2. Artist & Organization Participation

These terms apply equally to individual artists, estates, collectives, institutions, and organizations submitting works to the Archive.

2.1 Public Archival Nature
 • All content published in Artmuseo | Archive is publicly viewable.
 • Contributors retain full copyright and moral rights to their works.
 • No ownership is transferred to Artmuseo.
 • However, by submitting content, contributors acknowledge that:
 • The Archive is designed for long-term or perpetual preservation.
 • Content may persist as part of a historical collection.
 • Permanent erasure is intentionally limited.

Participation constitutes informed consent to archival permanence.


2.2 Visibility Controls and Limits on Deletion
 • Contributors may hide or restrict visibility of their content using platform tools.
 • Contributors may not demand full deletion solely due to personal preference changes.

Deletion or permanent removal may occur only under limited circumstances, including:
 • Proven authorship disputes
 • Verified legal violations
 • Clear submission errors (e.g., accidental uploads, metadata mistakes)
 • Peer-reviewed challenges confirming the submitter lacks rightful ownership

Artmuseo reserves discretion to preserve archival records while restricting public access.


2.3 Authorship, Honesty, and Legal Responsibility

By submitting content, contributors affirm that:
 • They are the creator, rights holder, or legally authorized representative.
 • The work does not infringe upon copyright, trademark, privacy, or moral rights.
 • All titles, descriptions, dates, and provenance information are truthful to the best of their knowledge.

Contributors bear full responsibility for the legality and authenticity of submitted content.


2.4 Platform Display & Contextual Use License

Contributors grant Artmuseo a non-exclusive, royalty-free license to display submitted works within the Artmuseo ecosystem for purposes including:
 • Archival presentation
 • Curated lists and highlights
 • Educational and informational contexts
 • Discovery previews and samples

Conditions:
 • Attribution is preserved.
 • Context is not materially altered.
 • Works are not sold, sublicensed, or commercially exploited outside the platform without separate agreement.


2.5 Verification, Identity, and Trust
 • Verification indicators require submission of accurate documentation.
 • Contributors affirm that they do not impersonate others or misrepresent identity.
 • Identity verification confirms the human or legal entity behind the work.
 • Verified identity information is not publicly disclosed unless explicitly permitted.

Artmuseo encourages verification to protect provenance, legacy, and trust.


2.6 Delegated Publishing & Third-Party Contributions

Contributors may authorize others (e.g., estates, curators, organizations) to publish on their behalf.

By granting such authorization:
 • The contributor accepts responsibility for published content.
 • The contributor controls whether others may post about or into their archive feed.


2.7 Content Standards

Artmuseo permits challenging, mature, and provocative art.

Prohibited:
 • Explicit pornographic video content
 • Material that would not reasonably belong in a cultural, academic, or museum context

Permitted:
 • Artistic nudity
 • Sexual themes within artistic, historical, or conceptual framing
 • Difficult or controversial subject matter

3. Archival Integrity & Persistence

Artmuseo | Archive is a historical record.
 • Content persistence is a core design principle.
 • Once content is distributed through archival or distributed systems, including IPFS-based infrastructure, complete technical reversal may not be possible.
 • This persistence is an intentional feature aligned with cultural preservation.

4. Ecosystem Integration

By using the Archive, contributors acknowledge that:
 • Works may interconnect with other Artmuseo applications.
 • Content may be referenced across the Artmuseo ecosystem.
 • Artmuseo operates distributed infrastructure, including IPFS-based networks for non-account private data.

No additional consent is required for internal ecosystem interoperability.

Legacy ownership and inheritance controls may be configured by contributors.

5. Viewer Responsibilities

Viewers agree to:
 • Respect copyright and attribution
 • Not scrape, alter, or republish content unlawfully
 • Not use published contact information for spam or harassment
 • Not misrepresent artists or works
 • Not manipulate or recontextualize works deceptively

6. Copyright & DMCA Compliance

Artmuseo respects intellectual property rights.

Copyright holders may submit notices under the Digital Millennium Copyright Act (DMCA).

Upon receipt of a valid notice, Artmuseo may:
 • Restrict public access to the material
 • Preserve the archival record pending review or dispute resolution

Restriction of access does not constitute erasure of historical record unless legally required.

7. Account Enforcement & Suspension

Artmuseo may restrict or suspend accounts that submit false, misleading, or unlawfully claimed content.

Enforcement decisions may involve:
 • Peer-based review
 • Community reporting
 • Internal curatorial and legal review

Actions are taken to preserve archival integrity and align with Artmuseo’s mission.

8. Jurisdiction & Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico and applicable United States federal law, without regard to conflict of law principles.

9. Dispute Resolution

Disputes arising from or relating to these Terms shall first be addressed through good-faith informal resolution.

If unresolved, disputes shall be submitted to binding arbitration in the Commonwealth of Puerto Rico, unless prohibited by law.

Each party shall bear its own costs unless otherwise determined by the arbitrator.

10. Modification of Terms

Artmuseo may update these Terms to reflect legal, technical, or operational changes.

Material changes will be communicated through the platform or website. Continued use after changes take effect constitutes acceptance of the updated Terms.

11. Data & Privacy

Use of Artmuseo is subject to the Artmuseo Privacy Policy. Visit https://artmuseo.io/privacy

Artmuseo complies with applicable data protection laws, including GDPR and relevant U.S. privacy regulations, where required by user location.

12. Age Requirements

Artmuseo accounts are available to individuals aged 18 and older.

Individuals under 18 may participate only with verified parental or legal guardian consent arranged through direct contact with Artmuseo.

13. Force Majeure & Platform Continuity

Artmuseo is not liable for delays, interruptions, or inability to provide services resulting from events beyond reasonable control, including natural disasters, infrastructure failures, network outages, governmental actions, or force majeure events.

While Artmuseo is designed for long-term continuity and distributed preservation, uninterrupted access is not guaranteed.
